Rules of purchase and sale of goods

1. General provisions
1.1. These electronic shop rules (hereinafter referred to as the Rules) constitute a legally binding document for the Buyer and the Seller (hereinafter referred to as the Seller), setting out the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend or supplement these Rules at any time. The Buyer shall be informed of changes to the Rules on the website of the electronic shop.

2. Conclusion of a purchase and sale agreement
2.1. The purchase and sale agreement between the Buyer and the Seller shall be deemed to have been concluded when the Buyer forms and submits an order for the goods in the electronic shop, having first read and understood these Rules.

3. Seller’s rights
3.1. In case of important circumstances, the Seller may temporarily or completely suspend the operation of the electronic shop without prior notice to the Buyer.
3.2. If the Buyer attempts to disrupt the operation, stability and security of the electronic shop or violates his/her obligations, the Seller shall have the right to restrict or suspend his/her access to the electronic shop without prior notice.

4. Seller’s obligations
4.1. The Seller undertakes to enable the use of services of the electronic shop, the conditions of operation which are set out in these Rules.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer by the method of delivery chosen by the Buyer, in accordance with the terms and conditions set out in these Rules of purchase and sale.
4.3. When, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the electronic shop, the Seller shall have the right to terminate the purchase and sale agreement with prior notice to the Buyer. The Seller may offer a similar product. If the Buyer refuses, the Seller undertakes to refund the money paid within 3 working days.
4.4. If the Buyer exercises the right provided in clause 5.2 of the Rules, the Seller undertakes to refund the money paid by the Buyer within 5 (five) working days from the date of receipt of the returned goods.
4.5. The Seller may not refund the amount paid by the Buyer until the goods are returned to the Seller or until the Buyer provides the evidence that the goods have been dispatched to the Seller, whichever occurs first.

5. Buyer’s rights
5.1. The Buyer has the right to purchase goods in the electronic shop in accordance with these Rules.
5.2. The Buyer has the right to withdraw from the purchase and sale agreement of goods concluded in the electronic shop by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. The Buyer may only exercise the Buyer’s right referred to in clause 5.2 if the goods have not been damaged or substantially changed their appearance and have not been used.

6. Buyer’s obligations
6.1. The Buyer shall pay for and accept the goods purchased in accordance with these Rules.
6.2. If the Buyer refuses to accept the goods at the time of delivery without important reasons, the Buyer must cover the expenses of returning the goods at the Seller’s request.
6.3. At the time of delivery of the goods to the Buyer, the Buyer shall inspect the condition of the package and the goods together with the Seller or the person who delivered the package.
6.4. By using the electronic shop, the Buyer confirms that he/she accepts these Rules of purchase and sale and must comply with them.

7. Prices of goods
7.1. The prices of goods in electronic shop are indicated in euros. Prices include VAT. Once the order has been confirmed, a delivery fee, if applicable, is added to the total amount.

8. Ordering and payment for goods
8.1. When the Buyer visits the electronic shop, chooses the goods that he/she likes and puts them in a shopping cart. After the shopping cart has been created, the Buyer shall enter the personal data necessary for the execution of the order: his/her name, surname, the address to which the goods will be delivered, the telephone number and any additional information that may be relevant for the delivery of the goods ordered. The Buyer confirms that he/she has read these Rules, and confirms the order.
8.3. Payments can be made using Swedbank, SEB, Luminor electronic banking services and Visa/MasterCard payment cards. Payments are available in euro. Payments are processed using the Paysera payment platform.

9. Delivery of goods
9.1. When ordering goods, the Buyer must specify the exact delivery address.
9.2. The Buyer must accept the goods in person. If the Buyer is unable to accept the goods in person, but the goods have been delivered to the address specified by the Buyer, the Buyer has no right to make a claim regarding the delivery of goods to the wrong person.
9.3. The Seller shall deliver the goods to the Buyer in accordance with the terms specified in the descriptions of the goods.
9.4. The special features of all goods on sale are listed in the description next to each item. The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods displayed in the electronic shop do not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer.
9.5. If the Buyer withdraws from the purchase and sale agreement of the goods, the Buyer shall refund all the amounts paid by the Buyer, including the delivery costs paid by the Buyer.

10. Return of goods
10.1. Goods of good quality can be returned within 14 days from the day of receipt. The defects of the sold low-quality goods shall be rectified, and the goods shall be replaced and returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. The following conditions must be observed when returning the goods:
10.2.1. The returned item must be in its original, neat packaging (this does not apply if defective goods are returned);
10.2.2. The item must not be damaged by the Buyer;
10.2.3. The item must be unused and in saleable condition: labels must not be damaged, protective films must not be torn off, etc. (this does not apply if defective goods are returned);
10.2.4. Completeness of the returned item must be the same as received by the Buyer (this does not apply if defective goods are returned);
10.2.5. The Seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning the goods have not been met;
10.2.6. The return of the goods shall be made in the manner prescribed by the Seller within 14 (fourteen) days from the date of receipt of the goods (this clause does not apply in case of defective item, in such a case returns shall be made within the statutory warranty period);
10.3. Return and replacement of goods of proper quality shall be made in accordance with part 1 of the article 6.22810 of the Civil Code;
10.4. Money paid for goods accepted by the Buyer but subsequently rejected shall be refunded to the Buyer’s bank account no later than within 5 (five) days from the date of return of the goods to the Seller, unless the Seller and the Buyer agree otherwise.

11. Final provisions
11.1. These Rules are drawn up in accordance with legal acts of the Republic of Lithuania.
11.2. These Rules and the relations between the Parties hereto shall be governed by and construed in accordance with the laws of the Republic of Lithuania.
11.3. Any disputes arising in connection with the implementation of these Rules shall be settled by negotiation. If an agreement cannot be reached, disputes shall be resolved in accordance with the laws of the Republic of Lithuania.
11.4. The Parties shall be released from their obligations under these Rules if the performance of their obligations is prevented by unforeseeable circumstances beyond the control of the Parties (force majeure).
